We have developed this privacy policy (“Privacy Policy”) to help you understand how we collect and use information. This Privacy Policy explains how we gather and use your information, whether due to your use of the Site (as hereinafter defined) or your receipt of services from us directly.
Zoleau offers an online platform for the purpose of connecting employers and job seekers. The web page located at www.zoleau.com, any mobile application that we make available to you (each a “Mobile Application”) and all linked pages together form the “Site”. When used herein, the term “Services” shall refer to any product or services we (i) make available to or perform for you through the Site, including any landing pages or informational pages; or (ii) otherwise provide to you directly and which Zoleau specifies to you are governed by the terms of this Privacy Policy.
This Privacy Policy applies to all users of the Site, including both (i) individual users using the Site for the purposes of finding a job (“Job Seekers”); and (ii) business users who use the Site for the purposes of connecting with Job Seekers (“Employers”).
Please read this Privacy Policy carefully and review it periodically for the latest information about our privacy practices. By using the Site and/or making use of Services, you agree to the terms of this Privacy Policy and consent to the use of your information by Zoleau as set forth herein. If you do not agree with the practices described in this Privacy Policy, please do not provide us with your personal information or interact with the Site and/or continue using or taking advantage of the Services.
We will routinely update this Privacy Policy to clarify our practices and to reflect new or different privacy practices, such as when we add new services, functionality or features to the Site and/or Services. If we make any material changes, we will notify you by e-mail (sent to the e-mail address specified in your account) or by means of notice on the Site or directly delivered to you prior to the change becoming effective. You can determine when this Privacy Policy was last revised by referring to the date it was “Last Updated” above. If you do not agree to the revised Privacy Policy, please stop using the Site and/or Services.
We collect only personally identifiable information (“Personal Information”) that is relevant and necessary to the purpose of the Site and/or Services. This information allows us to provide you with a customized and efficient experience. We collect the following types of information from our users:
We receive and store any information you directly provide through the Site and/or Services or provide to us in any other way, including by e-mail, as further detailed below.
Direct Communication: When you send an e-mail to Zoleau or communicate with us by telephone, we may retain your e-mail address or phone number and records of the contents of the communications. Additionally, when you send communications to other users of the Site and / or Services, any Personal Information you include in those communications will be delivered to the user with whom you are communicating.
Voluntary Disclosure: When you choose to provide us Personal Information, such as by filling in forms or corresponding with us, or to include Personal Information in a posting you make on or through the Site and / or Services, we may receive and store that Personal Information.
User Account: In order for you to use parts of the Site and/or Services, you will have to complete a registration form and create a user account (an “Account”). As part of this registration process, we may require select Personal Information such as your first and last name, job title, phone number, and a valid email address, The administrator(s) of an Employer’s Account will be required to provide certain Personal Information in order to make use of such Employer’s Account, including, but not limited to such administrators’ full name, job title, and e-mail address.
Purchases: In the event that you purchase a products or services through the Site, you may be asked to provide certain Personal Information.
Payment Information: We do not collect or store any financial information. We contract with third party payment providers (“Payment Partners”) to perform all payment processing on our behalf. Any financial information you provide through the Site or Services is provided directly to the Payment Provider the Payment Provider’s use of such information is governed by their then-current privacy policy.
Third Party Services: When you interact with the Site and/or Services using third party sites or services (a “Third Party Service”) and you authorize such Third Party Service to share your Personal Information with Zoleau (whether explicitly or through agreement with such Third Party Service’s privacy policy), we may receive your Personal Information from such third party service provider.
Non-Provision of Information: Please note that you can choose not to provide us with certain Personal Information, but then you may not be able to take advantage of all of the Site or Services.
When you provide us with your information, we may use such information for a number of purposes, including:
•To facilitate communication between Zoleau and you including, without limitation, responding to your questions or comments, sending e-mails concerning our products and services, or to contact you for feedback regarding us or our business partners, which may include the provision of your information to a third party for the purposes of managing our email communications;
• To administer your Account and provide products or services to you and other users of the Site, including providing users with a list of suggested users to connect with;
•For Zoleau marketing and promotional activities;
•To provide you with important functionality changes to the Site and / or Services, new services, and special offers from Zoleau and reputable third parties that we think you will find valuable;
• To customize, analyze, adjust and improve the Site and / or Services to meet our or our business partners' needs and expectations;
•To process purchase transactions you make through the Site and / or Services;
•To enforce our agreements with you, prevent fraud and other prohibited or illegal activities, for other legally permissible purposes and generally to ensure that we comply with applicable laws; and / or
• To contact you with non-essential business communications by e-mail, if you have opted to be contacted by Zoleau by e-mail.
Rest assured that we neither rent nor sell your Personal Information to anyone and that we will share your Personal Information only as described below.
Published Content Zoleau may choose to make certain portions of the Site available to the public. To the extent that you choose to include Personal Information in any portion of the Site, that Personal Information will be available to members of the public to the extent that the content in which it is contained is made available to the public. Additionally, any Personal Information contained in any content you make available on or through the Site will be viewable by other Zoleau users.
Fulfilment of Services We may retain other companies and individuals to perform certain functions on our behalf. Examples include, but are not limited to, companies and individuals who: (i) administer the Zoleau accounts; (ii) process payments; (iii) conduct surveys or promotional activities; (iv) deliver products or services; or (v) provide customer support, web hosting, internet service, and data analysis. Such third parties may be provided with access to information needed to perform their functions but may not use such information for any other purpose.
Protection of Zoleau and Others We may release Personal Information when we believe in good faith that release is necessary to comply with a law; to enforce or apply our terms of use and other policies; or to protect the rights, property, or safety of Zoleau, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
Business Transfers In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that are transferred. Moreover, if Zoleau, or substantially all of its assets, were acquired, user information would be one of the assets transferred.
Zoleau Personnel Zoleau personnel and authorized consultants and / or contractors may have access to Personal Information, where such access is necessary in the normal course of Zoleau business.
Postings You understand that by making any postings on or through the Site or Services, any content contained therein (“Shared Content”) may be copied, used, modified, or distributed by any other users, and that this cannot be controlled by Zoleau and that, additionally, such Shared Content may be publicly viewable. Further, you understand that once you have posted or published Shared Content, it cannot always be withdrawn from the internet, for example, if you or other Site users have shared or posted it to websites we do not control. Please consider carefully what Shared Content you choose to share, if you do not wish your Personal Information to be shared or publicly available in this manner, please do not include it in the Shared Content you choose to share. You should not post or publish sensitive information, such as financial information, in your Shared Content. You hereby agree that Zoleau has no responsibility or liability whatsoever for any such activities. You assume all risks associated with your Shared Content including, but not limited to, any third party’s reliance on its quality, accuracy, or reliability, or any disclosure of information in your Shared Content that makes you or others personally identifiable. You hereby agree that Zoleau has no responsibility or liability whatsoever for any such activities.
Linkage to Third Party Sites To the extent you link your Account to any Third Party Services or provide your information to any Third Party Services in connection with your use of the Site and / or Services (including but not limited to event hosting platforms), such Third Party Services are not subject to this Privacy Policy and as such, their collection and use or your information, including your Personal Information, cannot be controlled by Zoleau and we are not liable for any collection, use, or disclosure by such Third Party Services of any Personal Information you choose to make available to or through any Third Party Services, whether through the Site or otherwise. Your use of Third Party Services is governed by any privacy policy or other terms and conditions they have in place from time to time.
Third Party Persons You may not provide us with the Personal Information of another person, or post someone else’s Personal Information on the Site, unless you have the consent of that person. If you choose to provide us with the Personal Information of another person, you represent and warrant that you have their permission and consent to do so, and their agreement to the terms of this Privacy Policy, as well as that of their parent or legal guardian if they are below the age of majority in their jurisdiction of residence.
Access and Rectification You may view and change the information contained in your Account by contacting us at the e-ail address set out below. You have a right to request access to your Personal Information and to request a correction to it if you believe it is inaccurate. If you have submitted Personal Information to Zoleau and would like to have access to it, or if you would like to have it removed or corrected, please contact us using the contact information provided below. We may require you to verify your identity before we provide you with access to your Personal Information. We will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain Personal Information in certain circumstances, for example if it contains Personal Information of other persons, or for legal reasons. In such cases, we will provide you with a reasonable explanation of why it is not possible to grant access to your Personal Information.
Compliance with Laws. You are responsible for complying with all applicable laws when you communicate or interact with another person through the Site, including without limitation, all privacy and anti-spam legislation.
Waiver of Liability ZOLEAU ASSUMES NO RESPONSIBILITY OR LIABILITY REGARDING ANY THEFT, LOSS, ALTERATION, OR MISUSE OF PERSONAL OR OTHER INFORMATION LAWFULLY PROVIDED BY ZOLEAU TO THIRD PARTIES OR WITH REGARD TO THE FAILURE OF ANY THIRD PARTY TO ABIDE BY THIS PRIVACY POLICY OR AGREEMENT BETWEEN THAT THIRD PARTY AND ZOLEAU.
Third Party Links We are not responsible for the practices employed by web sites linked to or from our Site or Services, nor for the information or content contained therein. Please remember that when you use a link or go from our Site or Services to another web site, including those sites that have a link on our Site or Services, you are subject to that other web site’s own rules and policies. Please read over those rules and policies before proceeding. We are not responsible for such third-party site’s collection and / or usage of your data.
Data Security We maintain a variety of commercially reasonable safeguards designed to protect your Personal Information from unauthorized access and disclosure. For example, we use industry accepted tools and techniques to protect against unauthorized access to our systems. You should be aware, however, that Zoleau has no control over the security of Third Party Services, or any other web sites on the Internet that you might visit, even where such other site is linked to our Site or Services. If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your information. We want you to feel confident using the Site and Services. However, no system can be completely secure. Therefore, although we take commercially reasonable steps to secure your information, we do not promise, and you should not expect, that your information, searches or other communications always will remain secure. In the event of a breach of the confidentiality or security of your information, we will notify you if reasonably possible and as reasonably necessary so that you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address(es) we have on record for you. You should also take care with how you handle and disclose your information.
Notice to California Residents Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask Zoleau for a notice identifying the categories of Personal Information which Zoleau shares with our affiliates and/or third parties for marketing purposes and providing contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request to us at the address set out below.
Children Zoleau does not intentionally collect information about children under the age of thirteen (13). If we learn that Zoleau has collected information from a child under the age of thirteen (13), we will delete that information as quickly as possible. If you think we have collected personal information from a child under the age of thirteen (13), please contact us at the e-mail address set out below. We require that minors between the ages of thirteen (13) and the age of majority in the applicable jurisdiction ask and receive a parent’s or guardian’s permission before using the Site and / or Services or sending information about themselves or anyone else over the Internet. If you are under the age of majority in your jurisdiction, you warrant that you have the express permission of your parent or legal guardian to use the Site and the Services and to give information about yourself to the Site. If you are a parent or legal guardian and have authorised a minor to use the Site and Services, you (i) agree that you are responsible for the online conduct of the minor, and for the consequences of any misuse of the Site and / or Services by the minor; and (ii) consent to the collection, use, and disclosure of the minor’s information as set forth herein.
Site Hosted in Canada The Site is hosted in Canada and is governed by Canadian law. If you are visiting the Site from outside Canada, please be aware that your information may be transferred to, stored, and processed in Canada, where our servers are located and our central database is operated. The data protection and other laws of Canada and other countries might not be as comprehensive as those in your country. By using the Site, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share that information as described in this Privacy Policy.
No Rights of Third Parties This Privacy Policy does not create rights enforceable by third parties.
